APPLICANT CONTENDS THAT:
His DD Form 214 does not reflect all of his authorized awards
and decorations.
In support of his request, the applicant provided a copy of two
DD Form 214s.
The applicants complete submission, with attachments, is at
Exhibit A.
STATEMENT OF FACTS:
The applicant initially entered the Regular Air Force on 19 Jul
71.
On 29 Nov 76, the applicant was furnished an Honorable
discharge, and was credited with 5 years, 4 months, and 11 days
of active service.
The applicants DD Form 214s reflects the award of the following
Air Force Medals and/or Ribbons:
- National Defense Service Medal
- Small Arms Expert Marksmanship Ribbon
- Air Force Longevity Service Award
- Air Force Good Conduct Medal
- Air Force Outstanding Unit Award
The remaining relevant facts pertaining to this application are
contained in the memorandum prepared by the Air Force office of
primary responsibility (OPR), which is attached at Exhibit C.
AIR FORCE EVALUATION:
AFPC/DPSID recommends disapproval of the AmnM, GCM, VSM, SWAM,
AFSM, AFOR, VCM indicating there is no evidence of an error or
an injustice.
The applicants active duty service dates are from 19 Jul 71 to
29 Nov 76. After a thorough review of his official military
personnel records, they were able to verify the award of the
AFOUA, NDSM, and SAEMR as already annotated on the applicants
DD Form 214, dated 1 Aug 74; therefore, no update is required.
They were also able to verify award of the AFLSA as annotated on
the applicants DD Form 214, dated 29 Nov 76.
They were unable to verify award of the AmnM. There is no
official documentation in the applicants record, nor did the
applicant provide any, such as a recommendation or Special Order
for award of the AmnM. The Special Order is the official source
documentation to verify an authorized award.
They were unable to verify award of the GCM. The applicants
dates of service, 19 July 71 to 29 Nov 76, are past the award
dates for the award of the GCM. However, the applicant did
serve during the award dates for the AFGCM as is currently
annotated on his DD Form 214.
They were unable to verify award of the VSM. Although they
located within the applicants official military record a Travel
Voucher (DD Form 1351-1c) indicating that the applicant was in
Saigon, Vietnam on 26 Apr 75 and from 27 Apr 75 to 28 Apr 75,
the applicants dates of service are past the award inclusive
dates for award of the VSM; rendering the applicant ineligible
for the award of the VSM.
They were unable to verify award of the SWASM. The applicants
dates of service are prior to the award inclusive dates for the
award of the SWASM; rendering the applicant ineligible for the
award.
They were unable to verify award of the AFSM. The applicants
active duty service dates are prior to the award authorization
period for the award of the AFSM; rendering the applicant
ineligible for the award.
They were unable to verify award of the AFOR. The applicants
dates of service are prior to the award authorization date for
award of the AFOR. The applicant was not on active duty as of 6
Jan 86 to be eligible for retroactive award of the AFOR.
They were unable to verify award of the VCM. They were unable
to verify the applicant was in the area of eligibility for an
aggregate of 6 months in support of the Vietnam Armed Forces for
award of the VCM.
To grant relief would be contrary to the criteria established by
DoDM 1348.33, Secretary of the Air Force, Chief of Staff and/or
the War Department.
Based on their review of the applicants official military
personnel record, they were able to determine the below Air
Force Medal and/or Ribbon should have been awarded:
- Air Force Outstanding Unit Award with one Bronze Oak Leaf
Cluster
Upon final Board decision, administrative correction of the
applicants official military personnel record will be completed
by AFPC/DPSOR.
A complete copy of the AFPC/DPSID evaluation is at Exhibit C.
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 30 Jan 15 for review and comment within 30 days
(Exhibit D). As of this date, no response has been received by
this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
(OPR) and adopt its rationale as the basis for our conclusion
that relief beyond that already granted administratively is not
warranted. Therefore, in the absence of evidence to the
contrary, we find no basis to recommend granting the requested
relief.
THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
